Parker v Waller & Ors [2012] UKUT 301 (LC)
The landlord (Mr Parker) of a property in Southsea failed to obtain a house in multiple occupation licence. In November 2010 Mr Parker was convicted of failing to obtain a licence and fined £525 plus costs. In January 2011 Mr Parker applied for a licence for the property. The tenants then subsequently applied for Rent Repayment Orders in February 2011. The First-tier Tribunal awarded them the full rent for the periods the tenants had lived in the property and the tribunal stated that it did not seen any reason why the repayment orders should be limited to less than the full amount of rent paid for the periods. Mr Parker appealed to the Upper Tribunal. Permission was granted for the appeal due to the statement that it was an improper use of the discretion of the tribunal. On appeal Mr Parker claimed that
