Van-Herpen v Green & Green 2023, Hastings County Court

This county court case considers whether a copy of the gas safety record should be given to the tenant following the installation of a new gas boiler and where a check has been carried out within twelve months from the date of installation or date of the last check.

The tenants moved in on the 5th September 2018 and a new boiler was installed the next day. The gas engineer issued a building regulations compliance certificate, a requirement after the installation of a new boiler, but this was not served on the tenants. A safety inspection was carried out on 14th November 2018 after a report from the tenant that there were issues with the boiler, but no gas safety record was issued, as the gas engineer advised the boiler was less than twelve months old. A further check was carried out in October 2019 at which point a gas safety record was produced and given to the tenants.
