HMO Tenancy Agreement 2 Years, 8 Months ago  
Hi, I have a landlord who intends to rent out an HMO to individuals with Autism. The council are insisting that each individual sharing the property must have their own tenancy. Is it OK to issue each person a standard AST which relates to their own room and the shared facilities available to them or do I have to use a different type of tenancy agreement.

No problem with tenants having standard AST for their own room since they would normally have exclusive possession of that room.
The main proviso here is whether the landlord is resident in the building. If he is a resident landlord for the purposes of the Housing Act 1988, then the tenancy cannot be an AST. Tenants of Resident landlords have less security of tenure and need to let under an ordinary common law tenancy agreement.
