Question Title: Gas safety regulations
| Question: 60 |
| I am writing to you in the hope that you may be able to help me regarding the gas safety regulations. I am a disabled person and I moved to my present address in 1992 because it has a downstairs room that could be converted to a bedroom. Within this room is fitted a Robinson Willey Firegem Visa 2 with safety controls. The council serviced this twice a year. In 1993 the Social Services disabled unit fitted an en-suite shower which also had safety devices fitted. All was fine - I had instant heat when I needed it to help me with my arthritis and a downstairs shower unit which meant I did not have to haul myself upstairs. This year, however, the gas service engineer disconnected my fire stating that new regulations required the disablement of any gas fire fitted in the same room as a shower and that my bedroom was now classified as a bathroom. Is he right ?

| We have looked into the regulations in this area. According to the guidance, the regulations referred to are not retrospective. The guidance notes provide the following advice: ROOM-SEALED APPLIANCES: Certain types of room-sealed appliances may not be fitted in certain areas (i.e. bathrooms and bedrooms). The restrictions came into force only to appliances fitted after 1 January, 1996 and do not apply to appliances that are already fitted and in place, unless there is a change of room use (e.g. to sleeping accommodation ) - Gas Safety (Installation and Use) Regulations Therefore, provided that the appliance was fitted before 1/1/96 or if the use of the room was changed before this date (or you inform them that it did) the gas engineer is not entitled to disconnect the appliance. You should, therefore, write to the council asking them to reconnect immediately.
