One of my landlords has told me that he is in the process of selling one of his properties. The new landlord will continue to use my services as agent. Will I need to set up a new tenancy agreement with this tenant?
Answer:
You will need to set up a new agency agreement between yourself and the new landlord as there will be a continuing legal relationship. However you will not need a new tenancy agreement. The responsibilities of the landlord continue until the tenant is informed, so the tenant should receive written notification to be timed for the date of the completion of the sale of the property. Reference should also be made that this letter is made under the provisions of section 48 Landlord and Tenant Act 1987 that notices to the landlord can be served at the address of your offices.
