| For many years, we have been renting a small flat to a single elderly gentleman in his sixties. He has an assured shorthold tenancy, which, in September of this year, was just extended for a further 12 months. Sadly, last month, he passed away whilst in hospital recovering from a stroke. What is the status of the tenancy and what should be do with all his belongings?

| The status of the tenancy is that it still exists. It automatically vests with the executor of the tenant's estate who will decide what to do. If there is no will and executors then the matter will be handled by the Official Solicitor and Public Trustee. This situation illustrates why it may be a good reason for the landlord or agent to know contact details for next of kin by asking for this information on tenancy application form. In practical terms, if you can identify the firm of funeral directors who dealt with the body, then they will normally know who is going to pay them.
