I have a joint letting of a house to four students for 6 months. One of the tenants wishes to leave after 3 months. How do I replace that person on the agreement by substitution ?
Answer:
There are two main options. You could prepare a new tenancy agreement which all the tenants should be asked to sign. Alternatively, you could draft and attach an addendum to the original tenancy agreement, which refers to the existing tenancy and gives the details of the substitution (including names, dates etc.). In law, any such addendum or variation to the tenancy agreement is known as a 'side letter' and should be signed by the contracting parties.
