Question Title: Information disclosure clauses in AST Agreements

Question:
344
We are currently adapting a standard Assured Shorthold Tenancy agreement for our future use. It seems like a good idea to include a data Protection clause in our agreement as a number of our tenants are elderly and receive Housing benefit. I cannot find an example of the wording for such a clause. Could you please advise?
Answer:
Although it is possible to put a standard disclosure clause into your tenancy agreements it may no longer be a wise approach. The Office of Fair Trading's Guidance on Unfair Contract Terms indicates that such a blanket term is most probably unfair and therefore unenforceable. It would be more appropriate to create a standard and separate mandate form which could be signed by the individual tenant, when appropriate, and a photocopy could then be sent to your local authority housing benefit section.
