Question Title: Nuisance

| One of my tenants is having to leave a property because of the intolerable behaviour of the owner occupiers of the house next door. This is not the first occupant who has had problems with the neighbours, although it is by far the most severe case. Am I under an obligation to tell incoming tenants of the problems that have gone before ? The neighbour is apparently mentally unstable and so the nuisance problems are unlikely to stop.

| Although it is difficult to see any direct legal obligation to inform prospective tenants on the basis of the legal term, caveat emptor, buyer beware, not to do so could cause problems for your landlord as the owner of the property. However, it may be useful for you to contact your local environmental health department if the issue is noise related and, if not, then the involvement of your local social services department. At the end of the day it may be necessary for the landlord to take legal action against the neighbours to seek an injunction to prevent the problematic behaviour and he should seek the advice of his solicitor.
