Question Title: Tenant gives Notice

Our tenants have given us one week's notice to quit. They are on a weekly periodic tenancy and quote legal advice given in our local evening paper by a local solicitor which states that for this type of tenancy, one week's notice is sufficient. Is this correct ?
Answer:
No. Unless the tenancy is an 'excluded tenancy' (i.e. resident landlord, holiday letting, former trespasser) then the tenant is obliged to give a minimum of four weeks' notice in writing. The notice must also expire on the last day or the first day of a period of the tenancy (Protection from Eviction Act 1977, s5). The notice must also be at least one full period's length of tenancy. Thus, the tenant must give at least one month's notice to quit if he pays on a monthly basis.
