Question Title: Extra occupiers

| We let a one bedroom flat let to sole tenant, with permission from the landlord for occasional visits of a child. After less than a month he has moved in a women, who calls herself his wife, and four children. What do I do?

| The tenant is clearly in breach of his tenancy agreement and the agreement can be terminated by service of a section 8 notice on ground 12 giving two weeks notice. This is not a mandatory ground. There is also an issue of overcrowding. If the situation satisfies the 'room &/or space standards' set out in sections 324-6 Housing Act 1985 then there would be overcrowding. There may be some assistance from the local housing authority. This may assist in persuading the tenant family to voluntarily surrender this tenancy. Negotiating with a tenant to resolve a problem will be cheaper and quicker than pursuing the breach through the courts.
