| The landlord wants his property back and has issued a s.21 notice, which has expired. The tenant has not left on the date given. What do I do now? Can the landlord write asking the tenant to leave before starting possession proceedings?

| Yes, the landlord can write asking the tenant to leave and he should give a final date by which he needs the tenant to leave - say 2 weeks ahead. He might want to point out that the tenant will be responsible for legal fees incurred in bringing court proceedings. This may encourage the tenant to leave but it is important to remember that if they do not leave you will need to start possession proceedings in the local county court. Until you have obtained a possession order from the court, you have no right to evict them (Protection from Eviction Act 1977, s.2).
