I have acted for many years for a landlord who has recently gone bankrupt. He owns a block of four flats, three of which he lets and the fourth he lived in, or at least he used to. I pay the rental income directly to the Trustee in Bankruptcy. My landlord has now got a new job in the north of England and this means that he lives there. He did not tell me to let his flat for him but I have now received a letter from the trustees that I have to let the flat. What should I do?
Answer:
There is a legal relationship between you and the landlord based on the agency agreement and there is a legal relationship between the trustee in bankruptcy and the bankrupt but there is no legal relationship between you and the trustee. You should contact the landlord and seek his instructions. If he agrees to the letting then there is no problem. If he disagrees then it becomes a matter to be resolved between the landlord and the trustee.
