My client wants to let a large property on a monthly rent of £4,000. Are there any special restrictions on what rent the landlord can charge ?
Answer:
Under the Housing Act 1988, tenancies at high rents (where the annual rent is greater than £25,000 per year)` cannot be assured (or AST). It is to be noted that the £25,000 figure is annualised and therefore if the proportional monthly rent is more than £2083.33 per month for a shorter term (e.g. only six months), the letting is still outside the Housing Act. Because the tenancy will be outside the provisions of the Housing Act 1988, there will also be no need to serve either a notice under s20 or Ground 1. At the termination of the tenancy, there is similarly no need for a s21 notice of possession; a simple notice to quit will suffice. The letting agreement will prescribe the main terms of the letting and the tenant will afford little extra statutory protection above the contractual agreement between the parties.
