| Is an agent responsible for negligence of a contractor ?

| There is generally no liability for the negligence of independent contractors who have not been appointed negligently. The agent would however be expected to take 'reasonable care' in appointing a contractor of sufficient skill and knowledge. Where the agent gave instructions to the contractor, then the agent might also be liable if the instructions were wrong, or the work inadequately specified. In the case of employing a gas engineer, the position is reasonably simple. There is only one organisation currently recognised by the Secretary of State whose members are deemed to be suitably qualified - CORGI.
