Question Title: Change of Ownership

| Our client landlord wishes to sell a tenanted property. The tenants have an assured shorthold tenancy. The landlord's mortgagee, the Woolwich Building Society says that the tenants must vacate for 24 hours during the transfer of the freehold. However, our own solicitor says that this is "bunk" ! Please can you advise us. The original tenancy terminates in two and a half months' time.

| Your solicitor is quite correct - there is no need for the tenants to leave the property and the building society are mistaken in thinking that this would affect their legal position. You must however remember to inform the tenants of the name and address of the new landlord.
