| What is the procedure if , in the case of an Assured Shorthold Tenancy agreement signed by a couple, they divorce and one vacates the property before the end of the fixed term ?

| As all members of a household over the age of 18 should be named on the tenancy agreement and as all the tenants listed are 'joint and severally liable', there should be no problems if a married couple divorce and one of the partners leaves before the end of the fixed term. A letter should be written to both of the tenants pointing out that they are both still liable for the rent for the remainder of the term. If you are prepared to allow one of the joint tenants to leave during the term, it would be wise to insist on the remaining tenant entering into a new agreement.
