Question Title: Gardens: New High Fence
| Question: 231 |
| We let a house Cambridge which is currently tenanted. Our tenants have complained to us that the neighbours have erected a high boarded fence (replacing an older and much lower fence). Given it restricts both the view and the amount of light entering the property, is there anything we can do ?

| Although it would have been good etiquette for your neighbour to discuss his new fence with you before starting work, there is no legal requirement that he does so (provided it is erected on his own land on at the boundary). As long as it is less than two metres high where it joins the neighbour's land, or one metre where it borders on to public land, planning permission is not generally required. There are no other restrictions on high fences or hedging unless it runs contrary to a planning decision (or restriction), a covenant in the title deeds, or affects the light of a building to the extent that it causes a nuisance (see LUJ Oct 98, p18 for more information). All that is left to you is to talk to your neighbour and see if the matter can be settled amicably and by mutual agreement.
