| The fixed term of an Assured Shorthold Tenancy has expired and the tenancy has become a statutory periodic tenancy. Can we agree a new fixed term ?

| Once the initial fixed term has become statutory periodic, it cannot normally be terminated except by order of the court. The only exception to this rule is where the landlord and tenant agree to create a new tenancy. When this agreement takes effect, the existing tenancy will be surrendered by 'operation of law'. It would be useful to put a recital to this effect in the new agreement so that it is clear that the new tenancy arises as a replacement of the existing statutory periodic.
