Question Title: Squatters
| Question: 223 |
| What is the procedure for evicting squatters ?
|
| Answer: |
| A squatter is a person occupying property without permission from the person entitled to possession. The correct legal term for a squatter is 'trespasser'. New rules regarding the eviction of squatters were introduced on August 24th 1995. Under these rules landlords and homeowners can now go to court to obtain an 'Interim Possession Order' against alleged squatters. Once an order is granted, the squatter has 24 hours after receiving the order to vacate the property. Failure to comply is a criminal offence and a person guilty of an offence can be imprisoned for up to 6 months and /or fined. The Letting Centre has produced a Factsheet (Letting Fact sheet 14) containing more detailed information entitled 'Squatters and the rules for obtaining possession.
