| Is it possible to 'contract out' of the obligation to pay Council Tax in the case of HMO's by inserting a clause in the tenancy agreement stating that the tenant agrees to pay any council tax due ?

| No. The regulations concerning the payment of council tax can not be contracted out of. Although in most cases it is the responsibility of the resident(s) of the dwelling house to pay the tax, regardless of whether they own or rent the property, an HMO is one of the exceptions.
