Who is responsible for pest control ? I recently had to call a pest control company out to one of my properties to exterminate a rat. Who foots the bill ? If it is the landlord can I insert a clause in the contract so that the tenant becomes responsible during the tenancy ?
Answer:
Landlords are not normally liable for pest control in rented property unless the problem was already in existence at the time the tenant(s) occupied or if it can be proven that the pest or infestation was a result of a failure to repair by the landlord or the infestation arose from any common area under the control of the landlord. In cases such as these where the landlord is responsible you would not be able to successfully contract out of the landlords obligation.
