How do I start an accelerated possession procedure? What forms and other paperwork will I be expected to provide?
Answer:
Only one form needs to be submitted. Form N5B, updated October 2001, is available from the local county court or the Court Service website at www.hmcourts-service.gov.uk. There are also guidance notes for the claimant in Form N5C. You should complete the form and attach the following documents: · The current or most recent written tenancy agreement · Copies of the required notice served under section 21 Housing Act 1988 · If the tenancy was set up before 28th February 1997, the written notice served in accordance with section 20 of the Act · Any other documents necessary to prove the claim for possession. One copy should be made for the court; one copy for each defendant and one should be retained for the defendant's records. All, except the last, should be sent with the appropriate fee to the court.
