I am taking a possession action against a tenant for rent arrears but I am having difficulty making the mortgage payments on the property, as I am not receiving any rental income. Is there anything I can do to speed the process up?
Answer:
The availability of early hearing dates is a matter of frequent concern. Whilst it is officially the judge that determines the priority of cases, in practice most of the daily administration is carried out by the court staff and good relations with those staff may prove helpful in getting an earlier hearing date in priority cases. You may also be able to speed matters up yourself. You could serve the summons yourself as seven days is allowed for postal service whereas personal service can be on the day of issue. Similarly you can apply for the 21 days between service and hearing to be shortened and for an expedited hearing.
