When can I use the Accelerated Possession Procedure (APP)?
Answer:
The answer to this question is really contained in the restrictions in the use of APP. It cannot be used to recover rent arrears. The procedure is generally only of use when the property is let on an assured shorthold tenancy and the fixed period has come to an end. It cannot be used for ordinary assured tenancies. There must be a written tenancy agreement and its use has, since October 2000 been restricted by the Human Rights Act.
