Question Title: Faxed Agreement

| We will shortly be letting a house to two joint tenants. We have therefore prepared the agreement in the names of both tenants but one of the tenants is currently overseas. Is a copy of her signature sent by fax acceptable ?

| Written consent to an agreement by telex, or (now more commonly) facsimile and similar electronic means is an acceptable means of securing written consent when parties are not able to sign in person. Such electronic copies are acceptable if needed to be produced in court. Therefore, where a party or parties to the tenancy agreement are not all available to sign, the absent part can be sent a copy of the agreement, and a facsimile copy of the signed document returned prior to taking occupation. It is good practice to get a real signature in due course but not strictly necessary.
