- One of the landlords for whom I manage property wants to change the locks on a flat where he believes that the tenant has done a ‘runner’. Can he do this?
Answer:
He would have to be very certain that the tenant had actually surrendered the tenancy. Only the courts have the authority to enforce the landlord’s right to get his property back from a residential tenant. In a recent case, a landlord changed the locks when he believed that a tenant had deserted a flat owing substantial rent arrears, but he was charged with unlawful eviction when the tenant returned three days later and was unable to gain access.
