What is disrepair ?
Answer:
Disrepair is defined as 'the condition of being worn out or in poor working order; a condition requiring repairs'. It is important to note the difference between disrepair and improvement. Disrepair only occurs when something that is already in existence is damaged or requires repair. For example, consider a tenancy agreement which required the landlord to keep the windows in good repair (a standard implied covenant for most residential tenancies). This covenant requires the landlord to repaint and maintain them as necessary to preserve them in reasonable condition. However, the repairing covenant would not normally require him to install draughtproofing to older style sash windows. This would constitute an improvement since these older style windows will always be inherently more draughty than modern windows with pre-installed draught seals.
