Question Title: Receipts for notices
| Question: 109 |
| Is it necessary for my notice requiring possession (s.21 notice) to have a portion at the bottom of the notice where the tenant signs as acknowledgement of receipt of the notice ?
|
| Answer: |
| No, there is no legal requirement for the notice to be receipted by the tenant for it to be valid. All that is required is that the notice is validly served on the tenant - again, we refer you to the article on page 23 for a discussion of the various methods available. Although getting a signature from the tenant evidencing receipt is not a strict requirement, it is however a very useful way of proving that the notice has been validly served. You can add a signature box or receipt area to your notices for this purpose. Of course, it is not always possible to obtain a signature and the tenant can simply refuse to sign.
