We are renting a property to a family. They have an au pair. Does she need to be included on the tenancy agreement ?
Answer:
As the 'au pair' is an employee, there is no requirement that she be named on the tenancy agreement. As the employer may wish to terminate the service agreement at any time, a replacement employee may be required to take over the existing accommodation in the employer's residence. As the accommodation is a prerequisite of the employment for the au pair to better carry out her duties, she is a service licensee. She may have the exclusive possession of the accommodation, but no tenancy is created.
