One of my tenants who is on a fixed term assured shorthold tenancy agreement of twelve months wishes to leave early - can she do so ?
Answer:
If the tenancy is a fixed term tenancy, but the tenant wants to move out before the end of the term, she can only do so if the landlord agrees that she can leave early, or if the tenancy agreement makes provision for this by way of a "break clause" and the tenant has followed any requirements for giving notice specified in the tenancy agreement. If the agreement does not allow the tenant to leave early and the landlord does not agree that she can break the agreement, the tenant will be contractually obliged to pay rent for the entire length of the fixed term. If the tenant leaves anyway, without the permission of the landlord the landlord or agent should make every effort to mitigate his loss by trying to relet the property, in such a case the tenant would be liable for paying the rent for any period that the property was not tenanted up to the end of the fixed term.
