I put my house with management company Your Pad in 2007. In Jan 2008 they started paying my rent late. In May 2008 they stoped altogether. I took them to court, one the case, had a ccj issued, instructed bailiffs but all to no avail.
The tennants had a signed agreement with Your Pad, not me, as i did not know that Your Pad was registered with the council as a private landlord. (i have no problem with council tennants)
I managed to get the tennants to agree for the council to pay me direct and they would make up the shortfall every month (council only paid part of the rent).
My tennants paid Your Pad a deposit and a month up front. Your Pad did not pass that payment on to me or put it in a govenment bond scheme etc. When Your Pad's director disappeared, so did all moneys owed to me and hundreds of others.
My tennants were given a new contract by me, but refused to sign it, as they did not want to agree to a guatentor (requested as i was unaware they had paid a deposit)
Soft as i am, i let them stay as i felt that it was not their fault Your Pad did not pass the rent on to me.
Now they have given me 4 days notice of vacancy, and are refusing to pay the last months rent as they say they have already paid it. I agree they have, but not to me, and i agreed with them that i would compromise. I would repair the damage to my property instead of requesting payment for damages caused. Again because i felt bad that they had already paid Your Pad.
On friday 1st it was agreed that they could pay half the remaining rent that afternoon and the other half the following month. I even agreed not to charge them the extra week they stayed into May.
They have now refused to pay a penny and will not give me their forwarding address and are not answering my calls. I live 200 miles away from my rental property so i cannot just pop down to see them.
Would i stand a chance if i went to a solicitor?
Because of the two months unpaid last year i am already in arrears with the mortgage company, and now it will be another month and possible reposession.
