Habinteg Housing Association v James [1994]

The landlord of property sued for possession on the grounds of rent arrears, but the tenant counterclaimed for breach of repairing covenants because the flat was infested with cockroaches. The court held that the landlord was not liable for nuisance or negligence, and an appeal was dismissed.
